Terms and Conditions

Please read my Terms & Conditions in full before placing a commision for artwork.

1. Reference Photo selection

a. Prior to taking a booking/order and paying a deposit, the client must provide suitable digital photos of their pet and agree with me a suitable reference photo. 

b. The client accepts full responsibility for sourcing and obtaining any necessary copyright permission for all images sent to me  This would include permission from professional photographers or pet owners if the portrait is a gift for a third party.

2. Copyright and use of artwork imagery.

a. I retain full copyright on all artwork I produce, including mock-ups or prints, and my artwork images may not be reproduced, published, or sold without my written permission.

b. I reserve the right to use any images of completed portraits and/or the reference photos to promote my Pet Portrait Business on my website and social media platforms. If desired, and with prior agreement, I can avoid using pet names in association with portraits in my promotional material.

3.  Booking and Payments

a. A 50% deposit is required to reserve a booking, the balance is due on completion of the portrait.

b. No credit terms are offered. 

c. From the date of making your booking you have a 14 day cooling off period in which you may cancel your order and receive your initial deposit back in full. After this 14 day period, cancellation charges apply.

d. Payments are taken via bank transfer and are not subject to VAT.

e. The expected time of completion will be given at the time of confirming the client's booking. If the client has a specific deadline for a special occasion, they should please discuss this with me prior to making the booking to see if the timescale is acheiveable.

4. Cancellation charges

If a client needs to cancel their portrait, they must let me know in writing as soon as possibl

a. Before starting the portrait
If the cancellation date is past the 14 day cooling off period, a £25 cancellation fee is payable to cover time spent on planning your portrait. The cancellation fee will be deducted from your deposit and the balance refunded.

b. After starting work on the portrait
Cancelling an order after I have started the artwork, means that the full value of the deposit becomes non-refundable to cover all costs incurred in planning and commencing the artwork.

5. Portrait Artwork

a. The final portrait will be a reasonable representation of the agreed reference photograph.  I will endeavour to match colours as close as possible, but may be restricted by photography quality, colour palettes available and individual monitor/screen settings and therefore I cannot be liable for any minor differences.

b. The client will be sent photographs of developmental stages of the drawing.

c. The client agrees to respond to each message sent in a timely manner and comment/approve the development of the drawing. The client accepts that any delay in responding to messages may significant increase in lead time or result in artwork rescheduling. 

d. If the client is unsatisfied at any stage they must notify me immediately by email to outline any concerns so that I can discuss any necessary alterations that are possible. All change requests must fall within the scope of matching the original reference photo.

6. Portrait Approval

a. I will provide the client with a final digital photo proof of the completed portrait. The client must approve this final proof by return email. If the client isn’t satisfied with the final proof of the portrait they may request one final set of changes, provided these changes are consistent with the original reference photo.

7. Completion and final payment.

a. After emailing approval of the final proof, the client agrees to pay the remaining 50% balance on the completed portrait plus shipping costs. After the final payment has cleared I will arrange shipping of the portrait.

8. Shipping of Completed Artwork

a. All portraits are provided unframed, with a white mount ready for framing. 

b. The portrait will be packaged to a high standard with suitable materials to protect it from damage as far as possible during transit. 

c. The package will be shipped by a courier with tracking capability.

d. The client agrees that proof of delivery supplied by the courier is evidence that the portrait has been received.

e. In the unlikely event that the portrait is damaged in transit the client must send photos of the package by email immediately on the day of delivery. The Client must return the artwork to me in its original packaging for repair or replacement. The client will meet any costs of the return shipment.

f. The client accepts that the lead time on a replacement will depend on my existing work schedule.

9. Changes after shipping

a. Once the completed portrait is received the responsibility for its care and handling transfers to the client and I cannot be liable for any damage that may arise thereafter.

b. General guidance notes on portrait care and framing come with the portrait which the client should read in full.​

c. In the unlikely event that the client is dissatisfied with the portraitl, but approved the final proof prior to dispatch, the client is not entitled to any refund unless there are significant differences to the final proof. 

d. If the client still wishes changes to be made to the final portrait they have 7 days to contact me to dicuss their requirements and it will be the responsibility of the client to meet all costs associated with returning the portrait and making any further changes. The customer accepts that the lead time on changes will depend on my existing work shedule.​

10. Privacy Policy

a. I will not sell, distribute or lease any of your personal information to third parties.
